1. Acceptance of terms

By accessing or using Cartinel ("Service"), you agree to be bound by these Terms of service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Description of service

Cartinel is a financial wellness tool that helps users make informed purchasing decisions by:

  • Detecting online purchase attempts via a browser extension
  • Showing the impact of purchases on personal financial goals
  • Tracking spending patterns and providing insights
  • Helping users stay on track with savings targets and spending limits

3. User accounts

3.1 Account creation

To use Cartinel, you must create an account. You agree to:

  • Provide accurate and complete information
  • Keep your account credentials secure
  • Notify us immediately of unauthorized access
  • Be responsible for all activity under your account
  • Be at least 18 years old

3.2 Account suspension and termination

By You: You may delete your account at any time from account settings. Upon deletion:

  • Your subscription will be cancelled immediately
  • Your data will be deleted within 30 days per our Privacy Policy
  • You may export your data before deletion
  • If eligible, refunds follow our 30-day money-back guarantee policy (see Section 4.4)

By Us: We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use policy
  • Engage in fraudulent, abusive, or illegal activity
  • Fail to pay subscription fees (downgrade to free tier)
  • Create multiple accounts to abuse free tier limits
  • Attempt to reverse engineer or compromise the Service

We will provide notice before termination except in cases of severe violations or legal requirements. Suspended accounts may be reinstated at our discretion.

3.3 Data export

You may export your data at any time in JSON or CSV format from your account settings. Exported data includes:

  • Financial goals and budgets
  • Purchase history and decisions
  • Spending analytics
  • Account preferences

We will provide your data export within 7 days of your request.

4. Subscription plans

4.1 Free tier

The free tier includes:

  • Up to 3 goals or budgets
  • 10 purchase interceptions per day
  • Basic analytics and history
  • Browser extension for Chrome and Firefox

4.2 Pro tier

The Pro tier is a paid monthly subscription ($4.99 for first 500 users) that includes:

  • Unlimited goals and budgets
  • Unlimited purchase interceptions
  • Advanced AI analytics
  • Smart notifications
  • Priority support
  • Early access to new features

4.3 Billing

AUTOMATIC RENEWAL

YOUR PRO SUBSCRIPTION AUTOMATICALLY RENEWS EACH MONTH ON YOUR BILLING DATE AND YOUR PAYMENT METHOD WILL BE CHARGED THE THEN-CURRENT SUBSCRIPTION PRICE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. YOU CAN CANCEL AT ANY TIME FROM YOUR ACCOUNT SETTINGS.

  • Subscriptions are billed monthly in advance
  • Billing begins on the date you upgrade to Pro
  • Payments are processed securely via Paddle
  • Prices are in USD or AUD based on your location
  • Early supporter pricing ($4.99) is locked in forever for the first 500 users

4.4 Cancellation and refunds

You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain Pro features until the end of the paid period.

30-Day Money-Back Guarantee: We offer a full refund within 30 days of your purchase, no questions asked. To request a refund, contact us at hello@cartinel.app. Refunds are processed through Paddle and typically take 5-10 business days to appear in your account.

After cancellation, your account reverts to the free tier, and you can continue using Cartinel with limited features (up to 3 active goals).

4.5 Failed payments

If your payment method fails:

  • We will attempt to charge your payment method up to 3 times over 7 days
  • You will receive email notifications of failed payments
  • Your account will be downgraded to the free tier if payment cannot be processed
  • You can update your payment method in account settings at any time

4.6 Price changes

We may change subscription prices at any time. For existing subscribers:

  • We will provide at least 30 days notice of price increases
  • Early supporter pricing ($4.99) is locked in forever for the first 500 users
  • New prices apply at your next renewal after the notice period
  • You may cancel before the new price takes effect to avoid being charged

4.7 Beta features and early access

Pro subscribers may receive early access to new features in beta. Beta features:

  • Are provided "as is" without warranties
  • May contain bugs or errors
  • May be modified or discontinued without notice
  • Are not covered by any service level agreements
  • Should not be relied upon for critical functions

You agree to provide feedback on beta features and understand that your use helps us improve the Service.

5. Acceptable use

You agree NOT to:

  • Use the Service for illegal or fraudulent purposes
  • Attempt to reverse engineer or hack the Service
  • Share your account with others
  • Scrape or collect data from the Service
  • Interfere with or disrupt the Service
  • Impersonate others or provide false information
  • Upload malicious code or viruses
  • Violate any laws or regulations

6. Intellectual property

6.1 Our intellectual property

Cartinel and its content (including text, graphics, logos, software) are owned by Cartinel and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

6.2 Your content and data

You retain all ownership rights to the data you input into Cartinel, including your financial goals, spending data, preferences, and other information.

By using the Service, you grant us a limited, non-exclusive, worldwide license to:

  • Store and process your data to provide the Service
  • Use anonymized, aggregated data to improve the Service and AI algorithms
  • Display your data back to you through the interface

This license terminates when you delete your account, except for anonymized data which cannot be linked back to you.

You represent and warrant that you have the right to input all data into the Service and that doing so does not violate any laws or third-party rights.

7. Disclaimers and limitations

7.1 No financial advice

Cartinel is a tool for tracking and awareness. It does NOT provide financial advice, investment advice, or tax advice. Consult a qualified financial advisor for personalized guidance.

7.2 Service availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind, except where such warranties cannot be excluded under applicable law (such as the Australian Consumer Law).

7.3 Accuracy

While we use AI to detect purchases and categorize transactions, we cannot guarantee 100% accuracy. You are responsible for verifying data.

7.4 Limitation of liability

To the maximum extent permitted by law, Cartinel shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

Note: Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

7.5 Australian Consumer Law

For Australian users, our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services supplied again if the services fail to be of acceptable quality and the failure does not amount to a major failure.

To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is limited, at our option, to:

  • Re-supplying the services, or
  • Paying the cost of having the services re-supplied

Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law or other laws that cannot be excluded, restricted, or modified by agreement.

7.6 Browser extension limitations

Our browser extension depends on third-party platforms (Chrome, Firefox, etc.). We are not responsible for:

  • Changes to browser APIs that affect functionality
  • Browser or app store policies that result in extension removal or restrictions
  • Compatibility issues with browser updates
  • Security vulnerabilities in the browser itself
  • Conflicts with other browser extensions

7.7 Third-party websites

The Service interacts with third-party merchant websites. We are not responsible for:

  • The availability, accuracy, or content of third-party websites
  • Transaction processing by merchants
  • Merchant pricing changes or errors
  • Privacy practices of third-party sites

7.8 Data accuracy

While we strive for accuracy in detecting purchases and categorizing transactions:

  • AI categorization may occasionally be incorrect
  • Purchase detection may miss some transactions or flag non-purchases
  • You are responsible for verifying all data and calculations
  • We are not liable for financial decisions made based on potentially inaccurate data

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your data.

9. Changes to terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance of the updated Terms.

10. Governing law and disputes

10.1 Australian users

These Terms are governed by the laws of New South Wales, Australia. Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded, restricted, or modified.

10.2 International users

For users outside Australia, these Terms are governed by the laws of New South Wales, Australia, except where your local consumer protection laws provide greater protections, in which case those laws apply.

10.3 Dispute resolution

Any disputes arising from these Terms will first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, disputes may be submitted to mediation or resolved in the courts of New South Wales, Australia, subject to your local consumer protection laws.

10.4 Class action waiver

To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class actions.

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, pandemics, internet service provider failures, or third-party platform changes (including browser updates or app store policies).

13. Indemnification

You agree to indemnify, defend, and hold harmless Cartinel and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your misuse of the Service
  • Your violation of any laws or regulations

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cartinel regarding the Service and supersede all prior agreements and understandings.

16. Assignment

You may not transfer or assign these Terms or your account without our written consent. We may assign these Terms or transfer our rights and obligations to a third party in connection with a merger, acquisition, or sale of assets. We will notify you of any such assignment.

By using the Service, you consent to receive electronic communications from us, including:

  • Service notifications and updates
  • Billing and payment receipts
  • Changes to Terms or Privacy Policy
  • Marketing communications (you may opt out)

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
